By downloading, installing, or using Facet ("the App"), you agree to the following terms. If you do not agree, do not use the App.
This is an agreement between you ("User") and Michael Becker, Obere Dorfstr. 6B, 90427 Nuremberg, Germany, contact: [email protected] ("Developer"). Apple Inc. is not a party to this agreement.
The Developer grants you a limited, non-transferable, non-exclusive license to use the App on any Apple-branded device you own or control, as permitted by the Apple Media Services Terms and Conditions. This license does not allow you to use the App on any device you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.
Free Tier: Facet offers a free tier with limited AI usage. The Free Tier is provided on a best-effort basis, is rate-limited, and may be temporarily unavailable, throttled, or reduced in scope without prior notice. There is no guarantee of availability or specific quota for the Free Tier. Continued access to AI features beyond the Free Tier requires a paid subscription.

Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan. You can manage and cancel your subscriptions in your Apple ID account settings at any time after purchase. Any unused portion of a free trial period, if offered, is forfeited when you purchase a subscription.
Right of withdrawal (EU consumers) — § 356 BGB / Directive 2011/83/EU: As an EU consumer you generally have a 14-day right of withdrawal for distance contracts concerning digital content and services. By purchasing a subscription and starting to use the Pro features immediately, you expressly consent to immediate performance of the service and acknowledge that you lose your right of withdrawal once the service has been fully provided, in accordance with § 356 (5) BGB. If you do not wish to waive your withdrawal right, do not start using Pro features within 14 days of purchase and request a refund via Apple's standard process.
Facet uses artificial intelligence (provided by Anthropic via Claude API) for mood analysis, insights, personalized prompts, and chat features. You acknowledge and agree that:
Facet is a self-reflection and journaling tool. It is NOT a medical device, NOT a mental health service, and NOT a replacement for professional psychological, psychiatric, or medical treatment.

The Developer assumes no responsibility for actions taken based on AI-generated content.
You retain all rights to the journal entries, letters, and content you create in Facet. The Developer does not claim ownership of your content. Your entries are stored on your device and, if enabled, your personal iCloud account, and are not accessible to the Developer.
You agree not to: (a) reverse-engineer, decompile, or disassemble the App; (b) abuse the AI features, including sending content that violates applicable laws; (c) use the App for any unlawful, harmful, or fraudulent purpose; (d) circumvent any security or access controls.
The Developer is solely responsible for providing any maintenance and support for the App. Apple has no obligation whatsoever to furnish any maintenance or support in connection with the App. For support, contact: [email protected]
The App is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The Developer does not warrant that the App will be uninterrupted, error-free, or that data will never be lost. In the event of any failure of the App to conform to any applicable warranty that cannot be disclaimed by law, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of the Developer.
To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of data, profits, or business, arising out of or in connection with your use of the App. The Developer's total liability shall not exceed the amount you paid for the App or the relevant subscription in the twelve (12) months preceding the claim. The Developer is liable only in cases of intent and gross negligence.
The Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; (c) claims arising under consumer protection, privacy, or similar legislation.
If a third party claims that the App or your use of it infringes their intellectual property rights, the Developer, not Apple, is solely responsible for investigating, defending, settling, and discharging any such claim.
You represent and warrant that: (a) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
You acknowledge and agree that Apple Inc. and Apple's subsidiaries are third-party beneficiaries of this EULA, and that upon your acceptance of the terms of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
Processing of personal data is governed by the Privacy Policy. By using the App you confirm you have read the Privacy Policy.
The Developer may update these terms from time to time. Continued use of the App after changes constitutes acceptance of the new terms. The current version is always available at facetjournal.app/terms.
This EULA is governed by the laws of the Federal Republic of Germany, excluding its conflict of laws rules. Mandatory consumer protection laws of the country in which you reside remain unaffected. Place of jurisdiction, to the extent legally permissible, is Nuremberg, Germany.
